Terms of Service

These terms govern use of the CommercialView platform at commercialview.ai (the "Service"). By creating an account or using the Service you agree to them. If you use the Service on behalf of a brokerage or company, you represent that you may bind that entity.
1. The Service
CommercialView lets commercial real estate brokers organize property surveys on maps, process property documents, and share view-only surveys with their clients through scoped links. Clients viewing a share link do not need an account and get read-only access to exactly what was shared with them.
2. Your content
- You own the surveys, documents, and data you upload. You grant us the limited license needed to store, process, display, and share it as you direct.
- Processing happens at your direction. Document preparation — including any modification of an uploaded document for client presentation — is a tool you operate. You choose what to upload, you direct the processing, and no processed document is visible to a client until you have reviewed and approved it. CommercialView acts solely as your service provider in carrying out these instructions.
- Your rights and your compliance. You represent that you have the rights needed to upload, modify, and share each document you put into the Service — including third-party brochures and marketing materials — and that your use complies with the laws and rules that apply to you: copyright law, your real-estate license law, REALTOR®/MLS rules, and the terms of any data or listing provider (for example, CoStar) whose materials you use. If you do not have the right to modify or reshare a document, do not upload it.
- Automated document review is a best-effort assistance tool. You review and approve files before sharing; you are responsible for the final check of anything you send a client.
3. Acceptable use
Don't misuse the Service. In particular, no: attempting to access another account's data; probing, scraping, or overloading the Service; uploading malware or unlawful content; reselling access without our agreement; or using the Service to violate the rights of others.
4. Accounts
Keep your credentials confidential. You are responsible for activity under your account. We may suspend accounts that threaten the security or integrity of the Service, and will tell you why unless the law prevents it.
5. Subscriptions and billing
Paid plans, where offered, are billed through Stripe on a recurring basis. You can cancel anytime and keep access through the end of the paid period. Fees are non-refundable except where the law requires otherwise. We may change pricing with at least 30 days' notice; changes apply from your next billing cycle.
6. Availability and changes
We aim for high availability but the Service is provided "as is" and "as available," and may change as we improve it. We back up data nightly, but you should keep your own copies of original documents that are important to your business.
7. Disclaimers
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Property data displayed by the Service comes from documents and entries provided by brokers; we do not verify it and it is not investment, legal, or brokerage advice.
8. Limitation of liability
To the fullest extent permitted by law: (a) neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data; and (b) our total liability for all claims arising out of the Service is limited to the amounts you paid us in the twelve months before the claim (or US $100 if you have paid nothing). Nothing in these terms limits liability that cannot be limited by law.
9. Indemnification
You will defend and indemnify us against third-party claims arising from content you upload or your violation of these terms, provided we notify you promptly and let you control the defense.
10. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, email hello@commercialview.ai with "DMCA notice" in the subject and include: identification of the work, the location of the allegedly infringing material, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We will remove or disable access to material identified in a valid notice and may terminate the accounts of repeat infringers.
11. Termination
You may stop using the Service and ask us to delete your account at any time. We may terminate for material breach with notice, or immediately for abuse or security threats. On termination we will make your data available for export for 30 days unless the law requires otherwise.
12. Governing law
These terms are governed by the laws of the State of Arizona, excluding its conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.
13. Changes to these terms
We will post changes here and update the date above; material changes will be flagged to account holders when they sign in. Continued use after changes take effect constitutes acceptance.
